WHAT IS COMPANY REGISTRATION/FORMATION?
Entrepreneurs at times gets so engaged in the running and growth of their business that they commit a mistake of mixing business money and personal money, income and debts are often mixed with personal funds, which over a period of time dilutes the personal assets of the Entrepreneur.
The solution to this problem, is formation of a Company (Private or Public), which would have separate legal entity from the entrepreneur and which can be used solely for the purpose of running the business.
The Companies Act of 1956 sets down rules for the establishment of both public and private companies. The most commonly used corporate form is the limited company, unlimited companies being relatively uncommon. A company is formed by registering the Memorandum and Articles of Association with the State Registrar of Companies of the state in which the main office is to be located

Partnership Firm Registration

WHAT IS PARTNERSHIP FIRM REGISTRATION?
Partnerships present the involved parties with special challenges that must be navigated unto agreement. Overarching goals, levels of give-and-take, areas of responsibility,
lines of authority and succession, how success is evaluated and distributed, and often a variety of other factors must all be negotiated. Once agreement is reached,
the partnership is typically enforceable by civil law, especially if well documented. Partners who wish to make their agreement affirmatively explicit and enforceable typically draw up Articles of Partnership.
Partnership firm is required to be registered under sections 58 and 59 of the Partnership Act, though it is not compulsory. Although registration of firm is not obligatory but partners usually go for registration because consequences of non registration are very severe and injurious to their interest.
 
Limited Liability Partnership (LLP) Registration
Limited Liability Partnership entities, the world wide recognized form of business organization has been introduced in India by way of Limited Liability Partnership Act, 2008. A Limited Liability Partnership, popularly known as LLP combines the advantages of both the Company and Partnership into a single form of organization. In an LLP one partner is not responsible or liable for another partner's misconduct or negligence, this is an important difference from that of a unlimited partnership. In an LLP, all partners have a form of limited liability for each individual's protection within the partnership, similar to that of the shareholders of a corporation. However, unlike corporate shareholders, the partners have the right to manage the business directly.An LLP also limits the personal liability of a partner for the errors, omissions, incompetence, or negligence of the LLP's employees or other agents.
 
Trust Formation
A public charitable or religious institution can be formed either as a Trust or as a Society or as a Company registered u/s 25 of the Companies Act. It generally takes the form of a trust when it is formed primarily by one or more persons. To form a Society at least seven persons are required. Institutions engaged in promotion of art, culture, commerce etc. are often registered as non-profit companies. These forms are enumerated as under:
Charitable Trust settled by a settlor by a Trust Deed or under a Will. Charitable or religious institution / association can be formed as a society. Charitable institution can be formed by registering as a company u/s. 25 of the Companies Act, 1956, as non profit company (without addition to their name, the word “Limited” or “Private Limited”).

NBFC Registration
A Non-Banking Financial Company (NBFC) is a company registered under the Companies Act, 1956 engaged in the business of loans and advances, acquisition of shares/ stocks/ bonds/ debentures/ securities issued by Government or local authority or other marketable securities of a like nature, leasing, hire-purchase, insurance business, chit business but does not include any institution whose principal business is that of agriculture activity, industrial activity, purchase or sale of any goods (other than securities) or providing any services and sale/purchase/construction of immovable property. A non-banking institution which is a company and has principal business of receiving deposits under any scheme or arrangement in one lump sum or in installments by way of contributions or in any other manner, is also a non-banking financial company (Residuary non-banking company).

Co-operative credit society means a co-operative society, the primary object of which is to provide financial accommodation to its members and includes a co-operative land mortgage bank.

Steps Involved
1) Document Requirements: Every Director must have PAN Card (if digital Signature is to be obtained for in the name of the said Director) issued by the Income Tax department as an Identity proof and one address proof in his/her name. Two passport size photographs of each Director are required. Clear Scanned copies of proofs and photos are preferred.
